1. Acceptance of Terms

Welcome to Alethe. These Terms of Service ("Terms") govern your access to and use of the Alethe mental health and consciousness tracking platform at getalethe.io (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility

To use Alethe, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Comply with all local, state, national, and international laws

3. Account Creation & Security

When you create an account:

• You must provide accurate and current information
• You are responsible for maintaining the security of your password
• You are responsible for all activity under your account
• You must notify us immediately of unauthorized access
• You may not share your account with others
• You may not create multiple accounts to circumvent limitations
• You may not impersonate others or misrepresent your identity

4. Acceptable Use

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code (viruses, malware, etc.)
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service
• Use automated tools to scrape or collect data
• Reverse engineer or decompile the Service
• Harass, abuse, or harm others
• Use the Service for any illegal or unauthorized purpose
• Share content that is hateful, violent, or sexually explicit

5. Service Description

Alethe provides mental health tracking, sleep optimization, and consciousness exploration tools designed to help you understand your well-being patterns. The Service is:

• Educational: For self-discovery and personal development
• Evidence-based: Grounded in psychological research
• Privacy-first: Your data is never sold or shared without consent
• Not diagnostic: Not a medical or clinical diagnostic tool
• Not therapy: Not a substitute for professional mental health care

6. Intellectual Property

Our Content

The Service, including all content, features, and functionality, is owned by Alethe and protected by copyright, trademark, and other intellectual property laws.

Your Data

You own your mental health data, tracking records, and results. By using the Service, you grant us a limited license to store, process, and display your data to provide the Service.

License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not:

• Copy, modify, or create derivative works
• Redistribute or resell the Service
• Remove copyright or proprietary notices
• Use the Service for commercial purposes without permission

7. Payment & Subscriptions

Free Tier

Basic tracking features are free forever. This includes:

• Daily check-ins (mood, sleep, stress)
• Basic assessments (PHQ-9, GAD-7, PSS)
• 30-day data history
• Basic insights

Paid Plans (ALETHE Pro)

Premium features require a paid subscription:

• Billing is automatic and recurring (monthly or annual)
• Prices are subject to change with 30 days notice
• You can cancel anytime (no refunds for partial periods)
• Failed payments may result in service suspension
• Pro features: Unlimited history, advanced analytics, therapist sharing, custom exports

8. Termination

By You

You may delete your account at any time through account settings. Upon deletion, your data will be removed from our active systems within 30 days.

By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• We discontinue the Service (with 30 days notice)
• Your account has been inactive for over 2 years

Upon termination, your right to use the Service ceases immediately. We will retain your data as described in our Privacy Policy.

9. Disclaimers

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results will be accurate, complete, or reliable
• The Service will meet your specific needs
• Any information provided will be current or up-to-date

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALETHE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Third-party conduct or content
• Unauthorized access to or use of our servers
• Any damages arising from your use of the Service
• Any health-related outcomes or decisions

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Alethe and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct on the Service
• Your breach of any representation or warranty

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@getalethe.io. We'll try to resolve it within 30 days.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for:

• Small claims court matters
• Intellectual property disputes
• Injunctive relief requests

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or collective action.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date
• Sending you an email notification (for significant changes)
• In-app notification upon your next login

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree with changes, you may delete your account.

14. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement
• Severability: If any provision is unenforceable, the rest remains in effect
• Waiver: Failure to enforce a right doesn't waive that right
• Assignment: You can't transfer your rights; we can transfer ours with notice
• Force Majeure: We're not liable for failures beyond our control (natural disasters, pandemics, infrastructure failures)
• No Agency: Nothing in these Terms creates a partnership, joint venture, or agency relationship
